In a nutshell, mediation is a means of assisted negotiation. In a mediation, one or more mediators assist parties in conflict to identify their interests and helps them to focus towards finding a resolution. Different from what occurs in arbitration, the mediator does not impose a decision on the parties, and, unless the parties expressly authorize the mediator, he does not propose solutions.
Mediation can be an efficient means to resolve, not just disputes between businesses, but also occurring inside business organizations. It is frequent that disputes arise between different departments in a business, that can disrupt productivity and customer service.
If found to be successful, mediation may conclude with an agreement in which the parties set for their agreements, which are often complied with because of the participation the parties had in reaching them.
